based in South Africa. By accessing our website, creating an account,
or using any of our services, you acknowledge that you have read,
understood, and agree to be bound by these terms in their entirety.
If you do not agree with any part of these terms, you must
immediately discontinue use of our platform. We reserve the right to
refuse service to anyone who violates these terms or engages in

the property of Smartly or our content providers and is protected by
South African and international copyright, trademark, and other
intellectual property laws.
Limited License
We grant you a limited, non-exclusive, non-transferable license to
access and use our content for personal, non-commercial educational
purposes. This license does not permit you to reproduce,
distribute, modify, or create derivative works based on our content
without explicit written permission.
User-Generated Content
Any content you submit to our platform, including comments, forum
posts, or feedback, becomes the property of Smartly. By submitting
content, you grant us a worldwide, royalty-free license to use,
modify, and distribute such content in connection with our
services.
Privacy and Data Protection

personal information in accordance with our Privacy Policy and
applicable South African data protection laws, including the
Protection of Personal Information Act (POPIA). By using our

Payment Terms and Refund Policy

We offer a 14-day money-back guarantee for new subscribers. Refund
requests must be submitted within 14 days of initial purchase and
must meet our refund criteria. Refunds are processed to the
original payment method and may take 5-10 business days to appear
in your account.
Limitation of Liability
To the maximum extent permitted by South African law, Smartly and its
directors, employees, and affiliates shall not be liable for any
indirect, incidental, special, consequential, or punitive damages
arising from your use of our platform, including but not limited to
loss of profits, data, or business opportunities.
Our total liability to you for any claims arising from or related to
these terms or your use of our services shall not exceed the amount
you have paid to us in the twelve months preceding the claim. This
limitation applies regardless of the legal theory on which the claim
is based.
Governing Law and Dispute Resolution
These Terms of Use are governed by the laws of South Africa. Any
disputes arising from or relating to these terms or your use of our
platform shall be resolved through binding arbitration in accordance
with the rules of the Arbitration Foundation of Southern Africa,
unless otherwise required by applicable consumer protection laws.
Before initiating formal dispute resolution procedures, we encourage
you to contact us directly to attempt to resolve any issues
informally. Many disputes can be resolved quickly and amicably
through direct communication.
Modifications to Terms
